| Bio: | Any of those wishing to be added to my friends list, please review and sign the following agreement and send to ladylark@gmail.com, or fax within 60 days of acceptance ---------------------------------------------------------------------------------------------------- Talkingpotato’s Terms of Service(TOS)/Non Disclosure Agreement (NDA) These conditions created by Talkingpotato were formed on October 7th, 2004, and will remain binding indefinitely. The privacy of this journal was founded after the breach of trust by other parties made it necessary to create a legal document. Item 1) Talkingpotato reserves the right to remove any user off her friends* list at any time for any reason. In the event of a removal due to the decision of the party other than Talkingpotato, no further communication electronically or otherwise is desired. Item 2) All posts are to be strictly confidential, failure to exercise confidentiality of the blog hereby known as “the journal” will result in removal from friends list of the journal. This includes any information shared with other parties not on the friends list of the journal. Item 3) Talkingpotato shall be given the right to use any and all such assets belonging to the party hereby known as "the reader" to use as she sees fit. This includes but is not limited to access to books, toilets, first born children, your living soul, and foodstuffs such as bread, milk and cheese. Any resistance will result in removal and/or banning. Item 4) Flaming and/or criticism shall result in swift removal from the friends list, possibly banning. Item 5) The following topics shall not be mentioned or spoken of in the journal, for reasons Talkingpotato is under no obligation to divulge: (a)-sex and sexual topics (b)-past failed partnerships which did not reach fruition (c)-breasts**; cleavage, bra size, mammory glands, etc. (d)-Kenny Rogers (e)-the words 'famboozle' 'wombat' 'osmosis' 'gnu' and 'chair' Mentioning of these topics/words will result in removal and/or banning. Item 6) Talkingpotato reserves the right to know when to hold em, know when to fold em, know when to walk away and if conditions are not adhered to, know when to run. Item 7) Talkingpotato furthermore reserves the right to ban any user from the journal, failure to accept the exercising of her rights will result in cancellation of past or future partnerships. Talkingpotato is 1/4th clown, don’t push her. She'll go BONKA BONKA on your butt, so help her she will. Item 8) In an addendum to Item 7; Talkingpotato also reserves the right to communicate or cease communication with the reader on the journal. Communication beginning on the blogs of adjoining parties does not imply or constitute further communication on the journal. Item 9) The journal must be accepted by the reader knowing that it is on an 'AS IS' basis. Demands for specific or additional content will be fulfilled at the sole discretion of Talkingpotato. Abusing privacy such as misusing information found in the journal calendar to locate filtered posts is unethical and can not be tolerated. Item 10) Any reference to this journal in another medium including, but not limited to, phone, letters, email, chat rooms or instant messaging, fall under the scope of the ToS. In addition to removal from the journal, communication via other said media may be affected by suspension or termination. Item 11) Failure to treat the journal or her person with respect and civility, as judged by Talkingpotato, will result in removal or banning. BONKA BONKA!! Item 12) The reader signs this document acknowledging that respect must be shown to fellow readers of the journal. Any and all offenses/altercations done by a fellow reader must be addressed away from the journal as a private matter between the two reading parties. Refusal to comply will result in comment deletion, and/or public execution by being pelted with bricks made from 'Talkingpotato's Own' Fecal Matter(tm). This popular execution mix is made in the heart of the Silicon Valley, ensuring freshness and potency all throughout the year. Next spring will be the release of Talkingpotato's Own- Light, for a painful death with half the calories! Item 13) The journal is not a plea or askance for any unlicensed psychological help and counseling. Any and all suggestions or exhortations regarding life, liberty and Talkingpotato’s unique pursuit of happiness will be measured against the prior history and references of said advisor. Incomplete references or lack of knowledge regarding personal history will result in advice being disregarded and proved invalid. Refrain from informing Talkingpotato that she will spend her future days alone with cats and smelling faintly of urine. Any such attempt to predict the uncertain downfall of the magnificent Spudly Empire will result in a swift removal, and well-wishing on your new career choice of personal psychic to the bloggers. Item 14) In the case of future altercations with Talkingpotato, the reader signs this document with the knowledge that all information shared within the journal is still to be kept under utmost privacy following secession. Failure to keep confidentiality, or false fabrication of occurrences, happenings, meetings and conversations will result in immediate cancellation and dismissal of any past and future partnerships and collaberations. Item 15) Talkingpotato reserves the right to keep adding to this list as more people tick her off/hurt her feelings/make her break out/vomit/poop unhappy gnomes. Talkingpotato suffers from a rare disease in which stress causes enraged garden gnomes to sprout in the potato's colon (Irritable Gnome Syndrome aka IGS). If medical conditions are especially severe, a bill (and perhaps some angry gnomes) will be sent to the offending party. I, the reader, have read and agree to these conditions stated above. ___________________________ sign here or you shall be hit with a fish! *A friend is defined as any user who has access to talkingpotato's locked posts. This partnership may eventually be upgraded to 'close friend', which includes but is not limited to any user who gives emotional support, one who loyally stands by the sacred code of friendship in which honesty is paramount, and one who is willing to contribute to the good of both parties, not to the detriment of the journal's owner. Failure to communicate pressing 'conflicts of interest,' and any losses suffered which go unreported until rectification is no longer possible voids all previous partnerships. **Breasts are defined as the area on the human body above the stomach and below the collar bone. This includes the male AND female chest region. Man breasts are just as offensive, if not moreso. Talkingpotato reserves the right to make additions to the TOS/NDA as she sees fit.
